By receiving or inquiring about receiving art or original designs from me, or acquiring one of my designs/art pieces secondhand, you are agreeing to these terms.

Terms of Service for artwork

Use of artwork
You may use artwork that you commissioned or was commissioned for you for personal use - ie display in a character gallery, use on a profile, etc. You may NOT use any of my artwork for commercial purposes, unless specifically stated and agreed to during the commission process. Commercial use includes, but is not limited to, making and selling of prints, charms, toys, books, etc., anything created using the artwork's design (including modified versions) and sold for currency both real and digital.

I retain the right to use the artwork for self promotion and portfolio examples. You may repost the commissioned image elsewhere, but credit me as the artist, and consider watermarking/resizing from the original file in order to prevent theft.

Modifying artwork
Cropping, rotating, tinting, and adding decorative filters is allowed. Painting over artwork, adding more figures or backgrounds, or otherwise editing the content of the image is not. Please credit me for any art reposted, even if it's been edited.

Payment
Payment should be on time. Please pay as soon as possible; 48hrs is the maximum amount of time I will allow, unless stated otherwise. Work will not begin until payment has been made.

I accept USD (through PayPal). Trades may also be worked out, but that is a case by case basis. Full refunds may be permitted if no work has begun on the commission; partial refunds are permitted at sketch phase, if the commission has one. Once the sketch is approved, or if the commission does not have a sketch phase, no refunds will be given.

I do not accept points or other virtual currencies.

Non-fungible Tokens/cryptocurrency
I do not accept cryptocurrency of any form as payment. My artwork is not permitted to be used as an NFT or in any crypto/blockchain project in any capacity, even if you are the person who commissioned it. Artwork created by me that is being sold on NFT/blockchain platforms has been stolen, and should be reported as such to be taken down.

I do not accept commissions or license existing artwork for NFT/blockchain related projects under any circumstances.

Terms of Service for character/design adoptables

These terms are in addition to the ones listed above for my artwork in general.

Use of adoptables
An adoptable is a premade or custom-made design of a character, prop, or other fictional thing, which becomes a collectible entity in its own right.

Once purchased, you own partial rights to an adoptable's design. The design concept and original artwork belongs to me, and must be credited accordingly; but you own the right to do what you will with the design/character within the rules of my Terms of Service, and I cannot continue to create new content with that design/character once it is no longer in my possession. I retain the right to use the original artwork for self promotion and portfolio examples. You may repost the image elsewhere, but credit me as the artist, and consider watermarking/resizing from the original file in order to prevent theft.

Modifying adoptables - one-off designs
One-off designs are designs that have no association to other content such as closed species or established settings. They are standalone designs with little to no extra information, intended to be transplanted into whatever the buyer may choose. These designs may be modified to suit the buyer, but the design should remain recognizable and edits must be made to a separate image (a new drawing) and not the original file. You may not remove my signature.

Modifying adoptables - closed species
Closed species are a species of fictional creature of my own design, individuals of which must be purchased through me. They are not free to make. Purchased adoptables of a closed species may be modified to a small degree, such as changing out ears, adjusting a hue, or moving minor markings around, but they should be approved by me first in order to keep things consistent and fair and made on a separate piece of work (a new drawing) rather than the original file. If you want a minor edit made to an adoptable you're purchasing, I can make the edit to the original file for you at time of purchase to make things easier. You may not remove my signature.

The above design alteration rules are superseded by what an associated ARPG or species group allows, such as the addition of new traits via in-game add-ons. However, these alterations should still be made to a new drawing, not the original artwork.

Sale and trade of adoptables
You may use, sell, and trade only adoptables that you own, be it through direct purchase from me or a deliberate purchase/trade/gift from someone who did buy it from me. Do not resell adoptables for a higher price than you paid for it. If you receive an adoptable in a trade (for art or another adoptable, etc) you may not resell it at any price, and neither may the recipient; as soon as an adoptable is traded it loses all selling potential, as you may not profit off of my work. The only exception is if I receive it back and update the design to resell myself. I do not recommend vouchers; if you decide to take them anyway, then i will not enforce them if you get scammed. Gifting and co-owning adoptables is allowed at your own risk.

Commercial use of adoptables
Commercial use includes making and selling of prints, charms, toys, books, etc., anything created using the adoptable's design (including modified versions) and sold for currency both real and digital.

Any adoptables that I create may NOT be used commercially. You may not use any of my designs, one-offs or otherwise, in any sort of publication, even if it is free of charge--this includes webcomics, books, games, etc. If you feel your usage may be encroaching on this, contact me and I will be happy to help sort it out.
